Terms and Conditions

• Custom Your Padel: the trading name of Bodegraven & Wilffert Enterprise, established at Tupolevlaan 73, 1119 PA Schiphol-Rijk, Netherlands.
• Customer: the natural person or legal entity who enters into an agreement with Custom Your Padel.
• Product: a padel racket or padel cover supplied by Custom Your Padel, with or without personalisation.
• Personalised product: a product that is given text, a logo, a photo, elements or a custom colour to the customer’s specifications.
• Consumer: a customer who is a natural person and is not acting for the purposes of their trade, business or profession.
• Agreement: any arrangement between Custom Your Padel and the customer for the supply of a product.

These terms and conditions apply to all offers, orders and agreements of Custom Your Padel. Any deviation from them is valid only if agreed in writing.

An agreement is concluded once the customer has completed their design in the online designer, placed the order and the payment has been received. For business orders, approval of the quote is sufficient, after which the order is delivered and invoiced.

Custom Your Padel starts finishing the product immediately on receipt of the order. If Custom Your Padel notices anything unclear in the submitted design, it will contact the customer before production starts. If the customer wants to make a change to the design, they indicate this in the notes during the ordering process, before the order is placed.

All prices are in euros and include VAT unless stated otherwise. Prices may change without prior notice, but orders that have already been placed and confirmed remain at the agreed price.

Private customers pay in advance using one of the payment methods offered. Business customers pay by invoice within 14 or 30 days, as agreed.

Custom Your Padel delivers private orders within 10 working days, in the Netherlands and in the rest of Europe: up to 7 working days of production, then up to 3 working days of shipping. Business orders of 5 to 99 rackets take 7 to 14 working days of production, depending on the quantity, followed by shipping. For 100 rackets or more, the delivery time is set out in the quote. These periods start on the day the order is placed and (where applicable) payment is received. Working days are Monday to Friday, excluding public holidays.

We deliver throughout Europe. Shipping costs vary by country and are shown at checkout before you pay. For deliveries outside the European Union, the destination country’s import duties and VAT may apply; these are payable by the recipient.

Custom Your Padel is not liable for delays caused by external parties such as carriers, unless the delay is due to intent or gross negligence on the part of Custom Your Padel.

A consumer who buys at a distance has a statutory cooling-off period of 14 days. This does not apply to personalised products: they are made to the customer’s specifications and are excluded from the right of withdrawal under Article 6:230p(f)(1) of the Dutch Civil Code. This applies to every racket and every cover with text, a logo, a photo, elements or a custom colour.

For this reason, Custom Your Padel takes care to check the submitted design before production starts. If the customer sees any reason to make a change, they indicate this before the order is placed.

A consumer can withdraw from the purchase of products that are not personalised, such as a blank racket or a premium cover without a design, within 14 days without giving any reason. The withdrawal period ends 14 days after the day on which the consumer, or a person designated by them, received the product. If an order contains both personalised and non-personalised products, the right of withdrawal applies only to the non-personalised products.

To withdraw, the consumer informs Custom Your Padel within the withdrawal period by email to info@customyourpadel.nl or with the model withdrawal form at the end of these terms. Using that form is not required; a clear statement is enough. The consumer then returns the product within 14 days to Tupolevlaan 73, 1119 PA Schiphol-Rijk, Netherlands. The direct cost of returning the product is borne by the consumer.

Custom Your Padel refunds all payments for the withdrawn products within 14 days of being informed, using the same means of payment the consumer used, unless the consumer agrees to another means. If the consumer withdraws from the entire order, the standard delivery costs are refunded as well. Custom Your Padel may withhold the refund until it has received the product back or until the consumer has supplied evidence of having sent it back, whichever is earlier. The consumer is liable for any diminished value of the product resulting from handling beyond what is necessary to establish its nature, characteristics and functioning.

Business customers have no right of withdrawal.

As a rule, Custom Your Padel does not take personalised products back. If the customer would nevertheless like a solution for a reason other than a production or delivery error, Custom Your Padel will consider this case by case. No rights can be derived from this. In the event of a production or delivery error, the warranty in Article 7 continues to apply in full: the customer is entitled to repair, replacement or a refund.

Custom Your Padel provides a 12-month warranty against defects in materials and printing under normal use, including a sticker that comes loose. Normal use means use that is consistent with the nature of the product (playing padel, including several times a week).

The warranty does not cover:

• Normal signs of use, such as scratches and scuffs from contact with the court or the walls.
• Damage caused by improper use, accidents or misuse.
• Damage caused by inadequate maintenance.

This warranty does not limit the customer’s statutory rights. A consumer is always entitled to a product that conforms to the contract (Article 7:17 of the Dutch Civil Code). If it does not, the customer can ask for repair or replacement and, if that is not possible, a price reduction or termination of the contract. These rights continue to apply after the 12-month warranty period.

Custom Your Padel is liable only for direct loss resulting from intent or gross negligence on the part of Custom Your Padel. In all cases, liability is limited to the invoice value of the order concerned.

Custom Your Padel is not liable for consequential loss, loss of profit, lost savings or other indirect loss.

The customer warrants that they are entitled to have the submitted design or logo printed on the product. Custom Your Padel is not liable for claims by third parties relating to the intellectual property in submitted files.

Custom Your Padel may use images of delivered products in its own marketing, unless the customer has objected to this in writing beforehand.

The customer reports any complaint about a delivered product within a reasonable time after discovering the defect, by email to info@customyourpadel.nl. For a consumer, a report within two months of discovery is always in time (Article 7:23 of the Dutch Civil Code). Custom Your Padel will respond within 5 working days and will aim to find a suitable solution.

All agreements are governed exclusively by Dutch law. Disputes will be brought before the competent court in the district in which Bodegraven & Wilffert Enterprise is established.

If the customer is a consumer living in another country of the European Union, the protection of that country’s mandatory rules continues to apply, and the customer can also go to the courts where they live.

These terms and conditions are a translation of the Dutch original. In the event of any doubt about their interpretation, the Dutch version prevails.
